Privacy Policy
Last updated: October 17, 2026
Access VA Benefits ("we," "us," or "our") works in association with the Law Office of David S. Rubalcava, APC. Access VA Benefits is a private company and is not affiliated with, endorsed by, or part of the U.S. Department of Veterans Affairs or any other government agency. This Privacy Policy explains what information we collect through our websites and personal intake pages (including this intake site, accessvaintake.com) and in the course of providing our services, how we use it, and the choices you have.
Information We Collect
- Contact information you provide, such as your name, email address, and mobile phone number, when you request a consultation, complete a form on this website, or become a client.
- Information about your military service, VA claims, and health that you provide or authorize us to obtain, such as service records (including your DD-214), VA claim file information, medical records, and disability ratings.
- Identifiers such as your Social Security number or VA file number are collected only through our secure intake process after you engage us — never through this website's forms. Please do not include them in a website form.
- Technical information about your visit to this website, such as pages viewed, browser type, and IP address, collected through cookies and similar technologies, including analytics tools. We do not use advertising pixels or remarketing trackers on pages that collect health or claim details.
How We Use Your Information
- To respond to your requests and provide VA disability claims assistance.
- To communicate with you about your case, including appointments, document requests, and status updates, by phone, email, and — with your written consent — text message.
- To operate and improve this website and our services.
- To comply with legal obligations.
Text Messaging (SMS) Program
We send text messages only to people who have given express consent. You can consent by checking the optional text-message box on our website form or by signing our written text-message consent form. Submitting our website form without checking that box does not enroll you in text messages. Consent is never required to request an overview or to hire us. We use your mobile number and consent records only to send the messages you agreed to and to keep records of your consent. We do not sell, rent, or share mobile phone numbers or text-messaging opt-in data or consent with third parties or affiliates for their marketing or promotional purposes. We may share this information only with service providers (such as our messaging platform) who help us send messages, and as required by law. Reply STOP at any time to opt out, or HELP for help. Please do not send Social Security numbers, medical records, or other sensitive information by text. If you text our (949) 549-1649 number first, that starts a conversation about your inquiry, and we will reply about that inquiry only — ongoing messages still require your separate express consent through the checkbox or signed consent form described above (Claude Round C).
Once you consent, we may send you conversational text messages about your own case (for example, follow-ups, document reminders, appointment reminders, and status updates) from Access VA Benefits at (855) 763-2822 or (949) 549-1649. Message frequency varies (typically 1–4 messages per month). Message and data rates may apply. You will receive one confirmation message after opting out and no further texts unless you opt in again. For help, reply HELP or call (855) 763-2822. Carriers are not liable for delayed or undelivered messages.
Mobile Information Is Not Shared or Sold
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; text messaging originator opt-in data and consent will not be shared with any third parties. We never sell or rent your mobile phone number.
How We Share Information
We do not sell your personal information. We share information only:
- With the Law Office of David S. Rubalcava, APC and its VA-accredited personnel, as needed to represent you before the VA;
- With clinical reviewers and other service providers who help us operate our business (such as phone, email, and case-management providers), who may use it only to provide those services;
- With the U.S. Department of Veterans Affairs and other agencies as necessary for your claim and as you authorize;
- When required by law, court order, or to protect our rights.
Some VA records — for example, records relating to treatment for drug or alcohol use, HIV, or sickle cell anemia — carry additional federal confidentiality protections, and we treat records covering drug or alcohol treatment, HIV, and sickle cell anemia with additional care. We use any such records only to assist with your claim and disclose them only as you specifically authorize in writing or as required by law.
Data Security
We use reasonable administrative and technical safeguards to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Data Retention
We keep your personal information only as long as needed to provide our services, support your claim, and meet legal, tax, and record-keeping obligations. When it is no longer needed, we securely delete or destroy it. You may ask us to delete your information by contacting us; some information may be retained where the law requires it.
Cookies and Tracking
Our website uses cookies and similar technologies to operate the site, process form submissions, and understand how visitors use it, including through analytics services. You can block or delete cookies in your browser settings, though some site features, including forms, may not work properly without them. Our website does not currently respond to "Do Not Track" browser signals.
Children's Privacy
Our services are not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us with information, please contact us and we will delete it.
Your Privacy Rights (California)
If you are a California resident, you may have rights under California law to know what personal information we hold about you, to request a copy, to request correction or deletion (subject to legal record-keeping obligations for client files), and to not be discriminated against for exercising those rights. We do not sell personal information. To make a request, contact us by phone at (855) 763-2822 or by email at privacy@accessvabenefits.com. We will respond within the time required by law.
